Pennsylvania has different levels of penalties dependent on the Blood Alcohol Concentration at the time of your infraction. The levels of penalty are as follows:

- .16 And Above
First Pennsylvania DUI Conviction
- B.A.C. .08-.099
- Probation for Six Months
- Fine Amount: $300
- B.A.C. .10-.159
- Jail Time: two Days or up to six Months
- Fine Amount: Between $500 to $5000
- Drivers License Suspension Duration: Twelve Months
- B.A.C. .16 Or higher
- Jail Time: 3 Days or up to 6 Months
- Fine Amount: Between $1,000 to $5,000
- Drivers License Suspension Duration: Twelve Months
- Limited Occupational Drivers License Possible After sixty days of suspension is served, ignition interlock may be required.
- Alcohol Highway Safety School Required
Second Pennsylvania DUI Conviction
- B.A.C. .08-.099
- Jail Time: 5 Days or up to 6 Months
