Pennsylvania has different levels of penalties dependent on the Blood Alcohol Concentration at the time of your infraction. The levels of penalty are as follows:

  • .10-.159
  • .16 And Above

First Pennsylvania DUI Conviction

  • B.A.C.   .08-.099
    • Probation for Six Months
    • Fine Amount: $300
  • B.A.C.   .10-.159
    • Jail Time: two Days or up to six Months
    • Fine Amount: Between $500 to $5000
    • Drivers License Suspension Duration: Twelve Months
  • B.A.C.   .16 Or higher
    • Jail Time: 3 Days or up to 6 Months
    • Fine Amount: Between $1,000 to $5,000
    • Drivers License Suspension Duration: Twelve Months
    • Limited Occupational Drivers License Possible After sixty days of suspension is served, ignition interlock may be required.
    • Alcohol Highway Safety School Required

Second Pennsylvania DUI Conviction

  • B.A.C.   .08-.099
    • Jail Time: 5 Days or up to 6 Months
    • Fine Amount: From $300to $2,500
    • Drivers License Suspension Duration: Twelve Months
  • B.A.C.   .10-.159
    • Jail Time: 30 Days or up to 6 Months
