Nebraska DUI Laws
First Nebraska DUI Conviction
- Minimum of 7 Days in jail, max 60 Days
- Fines up to $600
- Drivers License Suspension up to six months or one year if B.A.C. is over .15
- Possible alcohol assessment/treatment
Second Nebraska DUI Conviction
- Up to 90 Days in jail or if B.A.C. is over .15 then minimum of 90 days, up to one year
- Fines Up to $500, or Up to $1,000 if B.A.C. is over .15
- Drivers License Suspension – 1 Year or from 1 to 15 Years (If Blood Alcohol Level .15 or above)
- Vehicle Immobilization – From 5 Days to 8 Months
- Vehicle Impoundment - Possible
- Ignition Interlock Device - Possible
- Possible alcohol assessment/treatment
Third Nebraska DUI Conviction
- Between 90 Days or one year in jail or if B.A.C. is over .15 then minimum of 180 days in jail and max five years.
- Fine up to $600, if B.A.C. is over .15 then up to $10,000
- Drivers License Suspension – From 2 to 15 Years or from 5 to 15 Years if B.A.C. is over .15 Vehicle Immobilization – From 5 Days to 8 Months
- Ignition Interlock Device - Possible
- Possible alcohol assessment/treatment
Nebraska Speed Limits
Basic Speed Rule: No person shall drive a vehicle at a speed greater than is reasonable and prudent considering the traffic, roadway and weather conditions.
- Twenty-five miles per hour in any residential district
- Twenty miles per hour in any business district;
- Fifty miles per hour upon any highway that is not dustless surfaced and not part of the state highway system;
- Fifty-five miles per hour upon any dustless-surfaced highway not a part of the state highway system
- Beginning on and after September 1, 1996, sixty miles per hour upon any part of the state highway system other than an expressway or a freeway, except that the Department of Roads may, where existing design and traffic conditions allow, according to an engineering study, authorize a speed limit five miles per hour greater;
- Sixty-five miles per hour upon an expressway that is part of the state highway system
- Seventy-five miles per hour upon a freeway that is part of the state highway system and upon the National System of Interstate and Defense Highways.
